1. Kişisel Verilerin İşlenme Amaçları

Bu doküman 6698 sayılı Kişisel Verilerin Korunması Kanunu ("Kanun") madde 10 çerçevesinde "Veri Sorumlusu" olarak Novametri Teknoloji Sanayi Ticaret A.Ş.'nin ("Novametri"), Kanun uyarınca Novametri'ya sunulmuş ve/veya toplanmış olan kişisel verilerinizin (adınız, adresiniz, telefon numaranız, e-posta adresiniz gibi kimliği belirli veya belirlenebilir gerçek kişiye ilişkin her türlü bilgi) ("Kişisel Veriler") işlenmesine ve bunlara dair haklarınıza dair aydınlatma yükümlülüğünün yerine getirilmesini sağlamak amacıyla hazırlanmıştır.

Novametri, Kişisel Verilerinizi; yasalar dahilinde mecburi/gerekli/yararlı işlemler gereğince muhafazası, Novametri'ya ürün ve/veya hizmet tedariki için gereksinim duyulması, Novametri müşterilerine sözleşmesel kapsamda hizmet vermek için gereksinim duyulması, bunlar kapsamında gerçekleştirilecek her türlü iş ve işlemin sahibini ve muhatabını belirlemek üzere bilgilerini tespit için kimlik, adres, vergi numarası ve diğer bilgilerini kaydetmek, kâğıt üzerinde veya elektronik ortamda gerçekleştirilecek iş ve işlemlere dayanak olacak bilgi ve belgelerin düzenlenmesi gibi amaçlarla işleyebilecektir.

2. Kişisel Verilerin Toplanma Yöntemleri ve Hukuki Sebepleri

Kişisel Veriler'in işlenmesi açısından Kanun kapsamında veri sorumlusu, Mustafa Kemal Mah. 2113 Sok. Barış Sitesi No:37 Çankaya/ANKARA adresinde yerleşik olan Novametri Teknoloji Sanayi Ticaret A.Ş.'dir. Novametri tarafından bu surette Kişisel Verileriniz Kanun'a uygun olarak işlenebilmekte ve muhafaza edilebilmektedir.

Kişisel Veriler, Novametri tarafından, Novametri müşterilerine ürün ve/veya hizmet sunması ve/veya herhangi bir nedenle Novametri ile sözleşmeli ya da sözleşmesiz ticari ilişki kurulması ve ifası kapsamında olmak üzere bilumum araç ve kanallar aracılığıyla sözlü, yazılı veya elektronik ortamda ve yukarıda yer verilen amaçlar doğrultusunda ve bu kapsamda Novametri'nın sözleşmeler ve kanunlardan doğan mesuliyetlerini eksiksiz ve doğru bir şekilde yerine getirebilmesi hukuki sebeplerine dayanılarak toplanmaktadır. Bu hukuki sebeplerle toplanan Kişisel Veriler, Novametri tarafından Kanun tarafından öngörülen temel ilkelere uygun olarak, Kanun'un 5. ve 6. maddelerinde belirtilen Kişisel Veri işleme şartları ve amaçları kapsamında işbu metinde belirtilen amaçlarla da işlenebilmekte ve aktarılabilmektedir.

Novametri, Kişisel Verileri sadece kesin, açık ve yasal amaçlar dâhilinde toplayacak, yukarıda ilgili bölümde açıklanan Kişisel Verilerin işlenme amaçlarının gerektirdiği süreler boyunca saklayabilecek olup Kişisel Verileri Kanun'da ve burada belirtilen çerçevede toplandıkları amaçlarla bağdaşmaz bir şekilde işlemeyecek ve işlenmesini gerektiren sebeplerin ortadan kalkması hâlinde, kanunen saklama mecburiyeti bulunan haller saklı olmak üzere, re'sen veya ilgili kişinin talebi üzerine silecek veya yok edecek veya anonim hale getirecektir.

3. Kişisel Verilerin Kimlerle ve Hangi Amaçla Aktarılabileceği

Novametri tarafından Kişisel Veriler, yukarıda belirtilen veri işleme amaçlarını gerçekleştirmek üzere, Novametri'nın hukuki uyum süreci, hukuki, mali, vergisel vb. denetimler amaçlarıyla iş ortaklarına, Müşterilerine, tedarikçi ve üreticilerine, doğrudan ya da dolaylı olarak yurtiçi/yurtdışı iştiraklerine, Novametri yetkililerine, Novametri içi birimlere, hissedarlarına, iç ve dış denetçilere ve anlaşmalı bağımsız denetim firmalarına, hukuk danışmanlarına, sair danışmanlık, destek veya hizmet aldığı veya almayı planladığı üçüncü kişilere (çeşitli ülkelerde sunucuları bulunabilecek bulut bilişim hizmeti sağlayıcıları da dâhil), kanunen yetkili kurum ve kuruluşlara ve özel kişilere, Kanun'un 8. ve 9. maddelerinde belirtilen Kişisel Veri işleme şartları ve amaçları çerçevesinde aktarılabilecek, yurtiçinde veya yurtdışında işlenebilecek ve Novametri tarafından ayrıca söz konusu Kişisel Veriler sair mecralar üzerinden de paylaşılabilecektir.

4. Veri Sahiplerinin Hakları (Kanun m. 11)

Kanun'un 11. maddesi gereği, Kişisel Veri sahipleri Novametri'ya başvurarak kendileri ile ilgili;

• Kişisel Verileri'nin işlenip işlenmediğini öğrenme,
• Kişisel Verileri işlenmişse buna ilişkin bilgi talep etme,
• Kişisel Verileri'nin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
• Yurt içinde veya yurt dışında Kişisel Verilerinin aktarıldığı üçüncü kişileri bilme,
• Kişisel Verileri'nin eksik veya yanlış işlenmiş olması halinde bunların düzeltilmesini isteme,
• Kanun'un 7. maddesinde öngörülen şartlar çerçevesinde Kişisel Verileri'nin silinmesini/yok edilmesini isteme,
• (d) ve (e) bentleri uyarınca yapılan işlemlerin, Kişisel Veriler'in aktarıldığı üçüncü kişilere bildirilmesini isteme,
• İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhlerine bir sonucun ortaya çıkmasına itiraz etme,
• Kişisel Veriler'inin Kanun'a aykırı olarak işlenmesi sebebiyle zarara uğramaları halinde giderilmesini talep etme haklarına sahiptirler.

1. Purposes of Processing Personal Data

This Privacy Policy has been prepared, in accordance with Article 10 of the Turkish Personal Data Protection Law No. 6698 ("Law"), by Novametri Teknoloji Sanayi Ticaret A.Ş. ("Novametri") acting as the "Data Controller", in order to fulfil its obligation to inform you about the processing of your personal data (any information relating to an identified or identifiable natural person, such as your name, address, phone number, and e-mail address — "Personal Data") submitted to and/or collected by Novametri, and about your related rights under the Law.

Novametri may process your Personal Data for purposes including: fulfilling legally required, necessary, or beneficial obligations; supplying products and/or services to Novametri; providing contractual services to Novametri's customers; identifying the parties to any related transaction by recording identity, address, tax number and other information; and preparing the information and documents underlying transactions carried out on paper or electronically.

2. Methods and Legal Grounds for Collecting Personal Data

For the purposes of processing under the Law, the Data Controller is Novametri Teknoloji Sanayi Ticaret A.Ş., located at Mustafa Kemal Mah. 2113 Sok. Barış Sitesi No:37, Çankaya/ANKARA, Turkey. Your Personal Data is processed and retained by Novametri in accordance with the Law.

Personal Data is collected by Novametri, verbally, in writing, or electronically, through any means and channel, in connection with the supply of products and/or services to Novametri's customers and/or the establishment and performance of contractual or non-contractual commercial relationships with Novametri, on the legal ground that Novametri must fully and accurately perform its obligations arising from contracts and applicable law. Personal Data collected on these legal grounds is processed and, where applicable, transferred by Novametri in accordance with the fundamental principles set out in the Law and within the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law, including the purposes described in this document.

Novametri will only collect Personal Data for precise, explicit and lawful purposes, and will retain it only for as long as required by the purposes described above. Personal Data will not be processed in a manner incompatible with the purposes for which it was collected, and, save for cases where retention is legally required, it will be deleted, destroyed, or anonymized — either on Novametri's own initiative or upon the data subject's request — once the reasons requiring its processing cease to exist.

3. Recipients and Purposes of Transfer of Personal Data

To achieve the data processing purposes described above, Novametri may transfer Personal Data — for purposes of legal, financial, tax and similar compliance and audit — to its business partners, customers, suppliers and manufacturers, domestic and international affiliates (directly or indirectly), Novametri officers and internal departments, shareholders, internal and external auditors and contracted independent audit firms, legal advisors, and other third parties from whom Novametri receives or plans to receive consultancy, support, or services (including cloud computing service providers whose servers may be located in various countries), as well as legally authorized public authorities and institutions and private individuals, within the personal data processing conditions and purposes set out in Articles 8 and 9 of the Law. Such Personal Data may be processed domestically or abroad and may also be shared by Novametri through other channels.

4. Rights of Data Subjects (Article 11 of the Law)

Pursuant to Article 11 of the Law, data subjects may apply to Novametri to:

• Learn whether their Personal Data is being processed,
• Request information about the processing if their Personal Data has been processed,
• Learn the purpose of processing and whether the data is used in accordance with that purpose,
• Know the third parties, domestic or abroad, to whom their Personal Data has been transferred,
• Request correction of their Personal Data if it has been processed incompletely or inaccurately,
• Request deletion or destruction of their Personal Data within the conditions set out in Article 7 of the Law,
• Request that the actions taken under the two items above be notified to third parties to whom their Personal Data has been transferred,
• Object to a result arising to their detriment through analysis of the processed data exclusively by automated systems,
• Request compensation for damages incurred due to unlawful processing of their Personal Data.
